Records relating to substance use disorder diagnosis, treatment, or referral for treatment may be subject to special federal confidentiality protections under 42 CFR Part 2. Those rules impose restrictions on the use and disclosure of patient records maintained in connection with a Part 2 program. The 2024 final rule aligned Part 2 patient notice requirements with HIPAA Notice of Privacy Practices requirements.
Where Part 2 applies, disclosures may require patient consent unless an exception applies under law. Requests for information may need to be handled in a manner that does not affirmatively reveal whether an identified person is receiving or has received substance use disorder treatment.
